Terms of Use
The short version
- Be respectful. Don't post anything illegal, abusive or that isn't yours to share.
- Distances, course data and handicaps in Condor are estimates for casual use, not official.
- You can delete your account whenever you like.
1. Agreement
These terms are an agreement between you and James Asherson ("we", "us"), who operates Condor. By creating an account or using Condor you agree to them and to our Privacy Policy. If you don't agree, please don't use Condor.
2. Who can use Condor
You must be at least 13 years old. If you're under 18, you need permission from a parent or guardian.
3. Your account
Give accurate information, keep your password private, and let us know if you think someone else has accessed your account. You're responsible for activity on your account.
4. Your content
You own the photos, captions, comments and other content you post. You give us a non-exclusive, worldwide, royalty-free licence to store, display and share that content with the people you choose to share it with, only as needed to run Condor. This licence ends when you delete the content or your account, except where others have already interacted with it as described in our Privacy Policy.
Don't post content that:
- is illegal, threatening, harassing, hateful or discriminatory;
- is sexually explicit or violent;
- you don't have the right to share, including other people's photos without their permission;
- impersonates someone else or is spam.
To report content or a user, email [email protected]. We may remove content and suspend or close accounts that break these terms.
5. Using Condor fairly
Don't try to access other people's accounts or data, interfere with or overload the service, scrape it, or reverse engineer the app except where the law allows.
6. Distances, courses and handicaps
GPS distances depend on your phone's GPS and on course data that may be incomplete or out of date. Treat them as estimates and use your own judgement on the course. Check whether your club or competition allows distance-measuring devices.
Handicap indexes in Condor are calculated from rounds you record, using a method based on the World Handicap System. They are for casual play and are not official handicaps issued by a golf association.
7. The service
Condor is currently free. We may add, change or remove features, and we may introduce paid features in the future, in which case we'll tell you before you're charged anything. We aim to keep Condor available but can't promise it will always be uninterrupted or error-free.
8. Disclaimer
To the extent the law allows, Condor is provided "as is" without warranties of any kind. Nothing in these terms limits rights you have under the Consumer Protection Act or other law that can't be excluded.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for losses arising from relying on distances, course data or handicaps in Condor. Our total liability to you for any claim relating to Condor is limited to the amount you have paid us in the 12 months before the claim, or R500 if you have paid nothing.
10. Ending your account
You can delete your account at any time in Settings → Account → Delete Account. We may suspend or close your account if you seriously or repeatedly break these terms, and we'll tell you why unless the law prevents it.
11. Apple App Store
If you downloaded Condor from the App Store:
- These terms are between you and us, not Apple. We, not Apple, are responsible for Condor and its content.
- Your licence to use Condor is limited to Apple-branded devices you own or control, as allowed by the App Store's usage rules.
- Apple has no obligation to provide maintenance or support for Condor.
- If Condor fails to meet any applicable warranty, you may notify Apple for a refund of any purchase price; to the extent the law allows, Apple has no other warranty obligation for Condor.
- We, not Apple, are responsible for any product liability, legal compliance or intellectual property claims relating to Condor.
- You confirm you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Governing law
These terms are governed by the laws of the Republic of South Africa. If you live in another country, you keep any protections its consumer laws give you.
13. Changes
We may update these terms. We'll change the date at the top and, for significant changes, tell you in the app or by email before they take effect. If you keep using Condor after that, the new terms apply.
